Secured Private Capital LLC and SPC Secured Loan Fund LLC are committed to maintaining the confidentiality and security of personal information of our investors and our borrowers. We want you to know how we protect and use this information.
Investors
We take great care to protect your personal information. When we do use your personal information, we do so with respect for your privacy. We restrict access to your personal information to principals and employees, and to outside accounting firms and legal firms, as is necessary to manage your investment in the Fund. We may use your personal information to service and maintain your account, to respond to inquiries from you, your purchaser representative (if you have one on file with us), any of your professionals (such as your CPA or attorney), and your IRA custodian in the case of a self-directed IRA. We may use your personal information to fulfill any legal and regulatory requirements, and for reporting suspicious transactions to law enforcement. We do not share your personal information with unaffiliated third parties for any purpose.
We safeguard your information with physical, electronic and procedural controls. We authorize our staff to get information about you only when they need it to perform tasks within the scope of their employment. We require companies working for us, including our outside accounting and legal firms, to use it only to provide the services we ask them to perform for us.
Borrowers
We also take great care to protect the personal and private business information of our Borrowers. We may collect both public and non-public information about you from any of the following sources:
- • your loan application
- • all documents provided by you and by third parties, in connection with your loan application
- • if we close a loan for you, the transaction activity in your account (for example, your loan payment history)
- • written and verbal communications with our employees and principals
- • information from credit reporting agencies
- • your broker (if you come to us through a broker), banker(s), bookkeeper, CPA and any attorneys
We may use your personal information to make underwriting decisions on your loan request. We may use your personal information to service and maintain your account, to respond to inquiries from you and any of your professionals (such as your CPA or attorney). We may use your personal information to fulfill any legal and regulatory requirements, and for reporting suspicious transactions to law enforcement. We may use your personal information to report to a credit bureau. We do not share your personal information with unaffiliated third parties for any purpose.
